Technical acceptability of witness and participant testimonies at traffic accident

This master’s thesis deals with issues of road traffic accidents from the perspective tes-timonies of witnesses of road traffic accidents, especially in terms of the space and time per-ception and in terms of the content development changes during time. This issues are solved at first theoretically, gained knowledge is then used by several real accidents. For each traffic accident was selected several questions important to solve its course and in the testimonies of witnesses and participants have found the answers to these questions. In the responses were monitored technical acceptability and content development of the testimonies during time, and then were made ratings of the technical acceptability of the each answer and score rating of compliance with the previous testimony. This allowed determining for each witnesses or participant and for every traffic accident level of technical unacceptability responses and the level of testimonies content development changes during time.

Witness and his testimony in civil proceedings Abstract The submitted diploma thesis deals with the testimony of a witness in civil proceedings. This is undoubtedly the most demanding means of proof. Its demanding character is given not only by the necessary preparation of the judge before this act, but especially in the subsequent assessment of the credibility of the testimony given. The diploma thesis aims to comprehensively describe the course of the carrying out witness testimony from the moment the witness enters the courtroom to the assessment of the witness's credibility within the reasoning of the court decision. Apart from the testimony, the introductory chapter deals with all the evidence means that can be presented in the Czech civil process with reference to their differences and similarities. The following chapter deals with the eligibility of the witness, the person of the witness and his witness duties. A witness need not comply with this statutory obligation if, by giving a testimony, he could cause a risk of criminal prosecution to himself or to a person close to him, or if he is bound by a duty of confidentiality. Witness in Criminal Proceedings

Witness in Criminal Proceedings The aim of this thesis is to provide a compact overview of the rights and duties related to a witness, which affect his position in criminal proceedings. The witness is considered as a one of the fundamental institutions of criminal law. The witness's testimony with its irreplaceable role also ranks among the most important evidence provided by criminal proceedings. The witness in principle can be found in all stages of on-going criminal proceedings, whereas the circle of persons, which may be witnesses, is not a priori restricted. The witness's role is in particular very significant in preparatory stage of criminal proceedings as without his testimony there is often impossible to identify the perpetrator of a committed crime. He is also important in such a trial, where the court based on his testimony is able to decide, whether an accused is in truth guilty, i.e. decide on his punishment, or on acquittal. Recognition in the Investigation of Crime

(in English): The thesis " Recognition in the investigation of crime" is studies the interaction and communication of criminal proceeding participants and its influence on the quality of those proceedings on recognition. The theoretical part deals with criminal proceedings such as all the trial requirements and factors which affect police investigation. Rights and responsibilities of all participants of trials are defined. Furthermore, communication, its types and categories and -most of all -its impact on successful police interrogation is examined. In conclusion of the theoretical part we describe the aspects which control the investigation and potential offender recognition. In the empirical part the aim was to find out what impact the quality of instructions has on successful offender recognition in simultaneous and combined format. The empirical part was performed in an experiment. The research participants were devided into categories according to chosen standards. Then they were presented with a video recording of a criminal offence followed by recognition. We targeted at discovering whether the instructions and the way they are given influence the results of recognition.

Comparative analysis of war photography and working methods of Patrick Chauvel and James Nachtwey

The goal of Comparative analysis of war photography and working methods of James Nachtwey and Patrick Chauvel bachelor thesis is to compare methods of war photography of two respected photographers, Patrick Chauvel and James Nachtwey. Author analyses and compares their professional life with focus on their professional milestones. The purpose is to describe their working methods, composition and subject selection, therefore how war is diplayed in their pictures supposing to document the conflict. This work is based on the assumption that photographers' distinct personality traits and strong opinions on war journalism necessarily influence their photographic style. Author analyses their respective iconic war photographies using visual analysis.
Problems of position of a witness in criminal proceedings

This diploma thesis deals with position of a witness in criminal proceeding. The first part, it defines a conception of a witness; focuses on legal process aspects of position of a witness and also on capability to act as a witness in criminal proceeding. The second part, is given attention to performing evidence by witness, to rules of examination of a witness, including rules of examination of witnesses less than 15 years old. The third part defines rights and duties of a witness in criminal proceedings as they result not only from Criminal Procedure Act but also from constitutional principles. There is closer focus on witness' duty to testify, to liability to participate in confrontation and recognition (as special kinds of evidence). Another focus is on some witnesses' rights: rights to deny giving testimony and right to legal help and mainly to right to afford security of a witness. The last, four part deals with institute of crown witness (accomplice witness). This institute is not included into Czech legal system yet.

- The examination of witness in a criminal process According to the title of this final paper, it concerns the most important procedural technique under the criminal process - the examination of a witness. It is the most widespread criminalistic and criminal technique which is irreplaceable in the criminal process. The basic task is finding the facts of the case beyond a reasonable doubt. A witness, as a person who testifies to circumstances of an examined case which he remembered and kept in his memory, is one of the basic institutes of criminal law next to the examination. His testimony is very important in checking, investigation and clarifying crimes and other criminalistic relevant events, more precisely in the whole process of clarifying criminal activities. The master's degree thesis is divided into six chapters. The principal part of the thesis is formed by the second chapter to the fourth one. In the introduction the history of the examination, the goal and the structure of the paper are mentioned shortly. The first chapter contains the definition of examination and kinds of examination and creates the beginning of the whole thesis. The important part of the paper is devoted to a witness.
